2.    Legal bases

The data protection term "personal data" refers to all information relating to an identified or identifiable individual. 

We process personal data in compliance with the relevant data protection regulations, in particular the DSGVO and the BDSG. Data processing by us will only take place on the basis of a legal permit. We process personal data only with your consent (Art. 6 para. 1 letter a) DSGVO), to fulfil a contract to which you are a contracting party, or at your request to carry out pre-contractual measures (Art. 6 para. 1 letter b) DSGVO), to fulfil a legal obligation (Art. 6 para. 1 DSGVO), or to process your personal data for the purpose of processing your personal data. c) DSGVO) or if the processing is necessary to safeguard our legitimate interests or the legitimate interests of a third party, unless your interests or fundamental rights and freedoms, which require the protection of personal data, prevail (Art. 6 para. 1 letter f) DSGVO).

4.    Resipient of the data

We make use of commissioned service providers for individual processing operations. This includes, for example, hosting, maintenance and support of IT systems, marketing measures or destruction of files and data carriers. These service providers process the data only according to express instructions and are contractually obliged to guarantee suitable technical and organisational measures for data protection. In addition, we may transfer personal data of our customers to bodies such as postal and delivery services, payment and information services, house banks, tax consultants/auditors or the tax authorities.

5. Processing in the exercise of your rights pursuant to Art. 15 to 22 DSGVO

If you exercise your rights pursuant to Art. 15 to 22 DSGVO, we will process the personal data transmitted for the purpose of implementing these rights by us and to be able to provide proof of this. For the purpose of providing information and preparing such information, we will process stored data only for this purpose and for purposes of data protection control and otherwise restrict processing in accordance with Art. 18 DSGVO. 
These processing operations are based on the legal basis of Art. 6 Para. 1 Letter. c) DSGVO in connection with Art. 15 to 22 DSGVO and § 34 para. 2 BDSG.

6.    Your rights

As a data subject, you have the right to assert your data subject rights against us. In particular, you have the following rights:

  • Pursuant to Art. 15 DSGVO and § 34 BDSG, you have the right to request information as to whether and, if so, to what extent we process personal data relating to you or not. 
  • You have the right to demand that we correct your data in accordance with Art. 16 DSGVO.
  • You have the right to demand that we delete your personal data in accordance with Art. 17 DSGVO and § 35 BDSG.
  • You have the right to have the processing of your personal data restricted in accordance with Art. 18 DSGVO.
  • You have the right, in accordance with Art. 20 DSGVO, to receive the personal data concerning you which you have provided to us in a structured, common and machine-readable format and to forward this data to another person responsible.
  • If you have given us a separate consent for data processing, you can revoke this consent at any time in accordance with Art. 7 para. 3 DSGVO. Such a revocation does not affect the legality of the processing, which has taken place until the revocation on the basis of the consent.
  • If you are of the opinion that the processing of your personal data violates the provisions of the DSGVO, you have the right to lodge a complaint with a supervisory authority in accordance with Art. 77 DSGVO.

 

7.    Right of objection

Pursuant to Article 21(1) DSGVO, you have the right to object to processing operations based on the legal basis of Article 6(1)(e) or (f) DSGVO on grounds arising from your particular situation. If we process personal data about you for the purpose of direct marketing, you may object to such processing pursuant to Art. 21 (2) and (3) DSGVO.

II. Data processing on our website

When using the website, we collect information that you provide yourself. We also automatically collect certain information about your use of the Site during your visit to the Site. In data protection law, the IP address is also considered to be a personal date. An IP address is assigned to each device connected to the Internet by the Internet provider so that it can send and receive data.

1.    Processing server-log-files

When using our website for purely informative purposes, general information that your browser transmits to our server is initially stored automatically (i.e. not via registration). This includes by default: browser type/version, operating system used, page accessed, previously visited page (referrer URL), IP address, date and time of the server request and HTTP status code. The processing is carried out to safeguard our legitimate interests and is based on the legal basis of Art. 6 Para. 1 Letter f) DSGVO. This processing serves the technical administration and security of the website. The stored data will be deleted after 14 days if there is no justified suspicion of illegal use on the basis of concrete indications and further examination and processing of the information is necessary for this reason. We are not in a position to identify you as a data subject on the basis of the stored information. Art. 15 to 22 DSGVO therefore do not apply pursuant to Art. 11 para. 2 DSGVO, unless you provide additional information to enable your identification in order to exercise the rights set out in these articles.

2. Data transmission to the USA

Visiting our website may involve the transfer of certain personal data to the USA. For the transfer of data to the USA as a third country, i.e. a country in which the DSGVO is not applicable law, the European Commission has decided in accordance with Art. 45 DSGVO that an adequate level of data protection is required for companies certified under the EU-US Privacy Shield. The transfer to the USA will then take place in a permissible manner. Certified companies are listed by the U.S. Department of Commerce: www.privacyshield.gov/list.

3.    Cookies

We use cookies on our website. Cookies are small text files that are stored by your browser when you visit a website. This identifies the browser used and can be recognised by our web server. If this use of cookies results in the processing of personal data, this is regularly based on the legal basis of Art. 6 Para. 1 Letter f) DSGVO This processing serves our legitimate interest in making our website more user-friendly, effective and secure. . In certain cases the processing is also based on your consent and in this case is based on Art. 6 para. 1 letter a) DSGVO.

We used so-called "session cookies", which are deleted when the browser session is closed. Other cookies ("persistent cookies") are automatically deleted after a specified period, which may vary depending on the cookie. You can delete cookies at any time in the security settings of your browser. You can object to the use of cookies through your browser settings in principle or in certain cases. 4. Contact possibilities and inquiries

Our website contains various contact forms through which you can send us messages. The transfer of your data is encrypted (recognizable by the "https" in the address bar of the browser). All data fields marked as mandatory fields are required to process your request. Failure to provide this information means that we cannot process your request. The provision of further data is voluntary. Alternatively, you can also send us a message via the contact e-mail. 

We process the data for the purpose of answering your inquiry. If your request is directed to the conclusion or execution of a contract with us, Art. 6 Para. 1 Letter b) DSGVO is the legal basis for data processing. Otherwise, we process the data on the basis of our legitimate interest in contacting inquiring persons. The legal basis for data processing is then Art. 6 Para. 1 Letter f) DSGVO.

5. Live chat via onWebChat

On our website we use a chat form of the Greek provider onWebChat. If you send us requests via the chat form, your details from the form including the contact details you provided there will be stored by us for the purpose of processing the request and in the event of follow-up questions. OnWebChat also allows us to store and analyze your chat history and track your use of our website. Cookies from onWebChat are also used via our website for this purpose.

Legal basis for the processing of personal data during the use of this service is Art. 6 Para. 1 Letter f) DSGVO. The processing is based on our legitimate interest in the provision of this service and the free design of our website. Alternatively, you can send us a message at any time via our contact e-mail address. The use of the chat tool is therefore purely voluntary.

6.    Newsletter

a.   Registration and deregistration
On our website we offer the possibility to register for our newsletter. After registration we will inform you regularly about current news to our offers. A valid e-mail address is required to subscribe to the newsletter. To verify the e-mail address, you will first receive a registration e-mail, which you must confirm via a link (double opt-in). If you subscribe to the newsletter on our website, we process personal data such as your e-mail address and your name on the basis of your consent. The processing is based on the legal basis of Art. 6 Para. 1 Letter a) DSGVO. You can revoke your consent at any time with effect for the future, for example via the "Unsubscribe" link in the newsletter or by contacting us via the channels mentioned above. 
The legality of the data processing operations that have already taken place remains unaffected by the revocation. When registering for the newsletter, we also store the IP address and the date and time of registration. The processing of this data is necessary in order to be able to prove that you have given your consent. The legal basis results from our legal obligation to document your consent (Art. 6 para. 1 letter c) in connection with Art. 7 para. 1 DSGVO).
b.    Analysis
The newsletter of PPS Pfennig Reinigungstechnik contains so-called Zählpixel. A counting pixel is a miniature graphic that is embedded in e-mails that are sent in HTML format to enable log file recording and analysis. This allows statistical evaluation of the success or failure of online marketing campaigns. Using the embedded pixel-code, the PPS Pfennig Reinigungstechnik can detect whether and when an e-mail was opened by an affected person and which links in the e-mail were accessed by the affected person.
Such personal data collected via the pixel-code contained in the newsletters are stored and evaluated by us in order to optimise the dispatch of the newsletter and to adapt the content of future newsletters even better to the interests of the addressees. This data processing is based on the legal basis of Art. 6 Para. 1 Letter f) DSGVO. You can object to the processing at any time by unsubscribing from the newsletter.
c.   Service provider
We use the Newsletter2Go GmbH as commissioned service provider for the dispatch of our newsletter. Your entered data and the analysis data will therefore be transmitted to Newsletter2Go GmbH.

7. Google Analytics (Universal)

We use the Google Analytics service of Google Ireland Limited (Ireland/EU) to evaluate our website visits. Google uses cookies to analyse your use of our website. This involves the processing of personal data in the form of online identifiers (including cookie identifiers), IP addresses, device identifiers and information about your interaction with our website. The information generated by the cookie about users' use of our website is generally transmitted to and stored by Google on servers in the United States. Google will use this information on our behalf to evaluate users' use of our online services, to compile reports on activities within our website and to provide us with other services relating to the use of our website and the Internet. Pseudonymous user profiles can be created from the processed data. 
We use Google Analytics only with activated IP anonymisation. This means that the IP address of the user is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. The IP address transmitted by the user's browser is not merged with other Google data. 
We use the Google Universal Analytics variant. This enables us to assign interaction data from different devices and from different sessions to a unique user ID. This allows us to contextualize individual user actions and analyze long-term relationships.
The data on user actions is stored for a period of 14 months and then automatically deleted. The deletion of data whose retention period has expired automatically takes place once a month.
The setting of cookies and the further processing of personal data described here takes place with your consent. The legal basis for data processing in connection with the Google Analytics service is therefore Art. 6 Para. 1 Letter a) DSGVO. You can prevent the storage of cookies by Google Analytics via a corresponding setting in your browser software. You can also prevent the collection of the information generated by the cookie by downloading and installing the browser plug-in available under the following link: tools.google.com/dlpage/gaoptout. If you visit our website via a mobile device, you can deactivate Google Analytics by clicking on this link. Please also note that we document the consent you have given us in order to comply with our obligation to provide evidence under Art. 7 para. 1 DSGVO. Since we are obliged to do so, this storage is based on the legal basis of Art. 6 Para. 1 Letter. c) DSGVO).

When Google Analytics is used, we cannot exclude the possibility that the data processed may be transferred to Google LLC, which is based in the USA. Google LLC (USA) is certified under the EU-US Privacy Shield.

8. Integrated services and contents of third parties

We use services, services and content (collectively, "Content") provided on our Website by third parties. For such an integration a processing of your IP address is technically necessary, so that the contents can be sent to your browser. Your IP address will therefore be transmitted to the respective third party providers. This data processing is carried out in order to safeguard our legitimate interests in the optimisation and economic operation of our website and is based on the following principles 
Legal basis of Art. 6(1)(f) DSGVO.  You can object to this data processing at any time via the settings of the browser used or certain browser extensions. One such extension is the uMatrix matrix-based firewall for the Firefox and Google Chrome browsers. Please note that this may result in functional restrictions on the website.

We have incorporated into our website content from the following third-party services:

When using Google services, we cannot exclude the possibility that the processed data may be transferred to Google LLC (USA), which is based in the USA. Google LLC is certified under the EU-US Privacy Shield.

  • YouTube" service from YouTube LLC (USA) to display videos. YouTube is certified as a subsidiary of Google under the EU-US Privacy Shield.
  • The OpenStreetMap service, offered by FOSSGIS e.V., for displaying maps.

 

III. Data processing on our Facebook fan page

When you visit our Facebook page, on which we present our company or individual products from our range, certain information about you is processed. Facebook Ireland Ltd (Ireland/EU) is solely responsible for this processing of personal data. 1. Processing of page insights

Facebook provides us with anonymous statistics and insights for our Facebook Page, which help us understand the types of actions people take on our Page (known as "Page Insights"). These Site Insights are created based on certain information about individuals who have visited our Site. This processing of personal data is done by Facebook and us as the joint responsible party. The processing serves our legitimate interest in evaluating the types of actions taken on our site and improving our site based on this knowledge. The legal basis for this processing is Art. 6 Para. 1 Letter f) DSGVO. Under no circumstances will we assign the information obtained via the Page Insights to a specific Facebook profile via the reference to "Like" information for our page.
We have reached an agreement with Facebook on processing as joint data controller, which defines the distribution of data protection obligations between us and Facebook. 2. The processing of data communicated to us through our site

We also process information that you have provided to us through our Facebook page. Such information may include your Facebook name, contact information or a message to us. We will only process this personally identifiable information if we have previously specifically asked you to provide it to us, such as in a survey or sweepstakes. This processing is carried out by us as the sole responsible party.

If your request is directed to the conclusion or execution of a contract with us, Art. 6 Para. 1 Letter b) DSGVO is the legal basis for data processing. Otherwise, we process the data on the basis of our legitimate interest in contacting inquiring persons. The legal basis for data processing is then Art. 6 Para. 1 Letter f) DSGVO.

If you have provided us with this information in order to participate in a competition, we will only process it in order to send you a prize if necessary. After delivery of the prize or if you have not won, we will delete the data. The legal basis for the processing is Art. 6 Para. 1 Letter b) DSGVO.
